One of the most common questions we get pertains to whether a new Technology employee should be classified as Exempt or Non-Exempt. Several key factors should be taken into consideration when making this decision. | “Classifying an employee as Exempt or Non-Exempt can be complicated with Technology Staffing. Careful consideration of the California Labor Code should be done for each hire. Please check with ESP if you have any questions regarding a specific position and we can tell you what our other Clients have done for that same role." |
Salary: Per the California Labor Code one of the required criteria is that a technology employee’s hourly rate of pay not be less than a certain threshold dollar amount. This Dollar amount changes each year and for 2008 the minimum is $36.00 per hour. Beware this is down $13.77 from the 2007 rate and you may need to adjust someone's classification. Check back to our website in January to see the new rate for 2009. |
Responsibility: A good rule of thumb for an exempt employee is if they are primarily engaged in work that is intellectual or creative and requires the exercise of discretion and independent judgment. Thus a Network Engineer who makes decisions as to the installation of network software and the configuration of that software would most likely be considered Exempt. On the other hand, a Network Administrator who adds and deletes users and troubleshoots basic network issues would be considered Non-Exempt. |
Management: A person employed in a Management role would most likely be considered Exempt. This person should direct the work of two or more other employees and would have the authority to hire or fire other employees or make suggestions and recommendations as to the hiring or firing. |
Classifying an employee as Exempt or Non-Exempt can be complicated with Technology Staffing. Careful consideration of the California Labor Code should be done for each hire.
